How we handle intellectual-property notices.

We take intellectual property seriously at Merch Sport, and we ask the same of everyone in our community. Our products are fan-inspired — not officially licensed by or affiliated with any team, league, athlete, or brand — and every trademark belongs to its rightful owner.

We respond promptly to clear, valid infringement notices submitted under the U.S. Digital Millennium Copyright Act (DMCA) and applicable law. If you believe something on merchsport.com infringes your intellectual-property rights, please send a written notice to our Designated Agent using the steps below.

Submit a Notice of Infringement

Our policy is to (1) remove or disable access to any content or listing we believe in good faith infringes someone else’s rights, once we receive a proper notice; and (2) cut ties with any supplier or partner found to be a repeat offender.

For your notice to be valid, it must include:

  1. The copyrighted work, trademark, or IP you believe was infringed, including any registration number if applicable.
  2. The material you believe is infringing — a description of how it infringes, plus the exact URL(s) or location on our site.
  3. Your full name, mailing address, phone number, and email.
  4. A statement that you genuinely believe the use isn’t authorized by the rights owner, their agent, or the law.
  5. A statement, under penalty of perjury, that your notice is accurate and that you’re the rights holder or authorized to act on their behalf.
  6. Your signature, physical or electronic.

What Happens After a Valid Notice

  1. We remove or disable the flagged content or listing.
  2. We let the relevant supplier or partner know it’s been taken down, if applicable.
  3. We cut ties with, and remove all content from, any supplier or partner who turns out to be a repeat infringer.

Submit a Counter-Notice

Think something was taken down by mistake, or that you have the right to use it (fair use, a license, etc.)? Send a counter-notice to our Designated Agent with:

  1. The content that was removed, and where it used to appear.
  2. A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
  3. Your full name, mailing address, phone number, and email.
  4. A statement that you agree to the jurisdiction of the U.S. Federal District Court in your area (or, if outside the U.S., the district where Merch Sport is based), and that you’ll accept service of process from whoever filed the original notice.
  5. Your signature, physical or electronic.

If your counter-notice checks out, we may pass a copy to the original complaining party and let them know the content could be restored in 10 business days. Unless they take legal action to stop it, the content typically goes back up within 10–14 business days, at our discretion.

Misrepresentations: under Section 512(f) of the DMCA, anyone who knowingly misrepresents that something is infringing (or that it was removed by mistake) can be held liable for damages, including legal costs.
